Aadhaar Linking to Bank Accounts and Mobile Numbers, Is it Mandatory? Should you Link it Immediately?

Do I need link my Aadhaar with my PAN, Bank Accounts or the mobile number immediately? This might be the confusion in your mind, as your banks or SIM operators are asking you to. Well Here is the answer, there is no need to panic. You have got time at least until 31st December 2017. There also may be the case you won’t need to do it at all, depending on the Supreme Court judgment due on 31st December. SC will start hearing the petitions from last week of November.

You must be getting repeated messages from banks and your mobile phone operators. These messages may indicate that the linking Aadhaar is very urgent. And if you don’t do so you may lose access to your accounts or your mobile number may be blocked.

Petitions in Supreme Court

According to new rules amended in Prevention of Money Laundering Act, the Govt. has mandated the linking Aadhaar with bank accounts. But not immediately as you might be interpreting from messages or emails you are receiving from banks or Mobile number operators.

There are several petitions filed in the Supreme Court, challenging the mandatory linking of Aadhaar card with different welfare schemes, PAN card, bank accounts and phone numbers. The Govt has also told the court earlier that it is willing to extend the deadline to March 31st next year for those who do not have Aadhaar yet. But on Monday it did a rethink and asked for an early hearing.

Some petitioners have termed the linking of the Aadhaar number with bank accounts and mobile numbers as “illegal and unconstitutional“.  Recently, a nine-judge constitution bench of the apex court had held that ‘Right to Privacy‘ was a Fundamental Right under the Constitution. The petitioners are challenging that the linking of Aadhaar is violating the Right to Privacy.

Security Reason

Another concern, you must consider before thinking to link your Aadhaar is the safety of the Aadhaar data. Mirror Now Editor Faye D’Souza in a report explained that the Aadhaar data is not safe right now, it is being leaked on the internet. The Aadhaar system has some flaws and Govt is still figuring things out. The Mirror Now team was able to get access to some Aadhaar data on the internet.

So as the Supreme Court is still hearing the case and the deadline is still 31st of December, 2017, ask your banker and mobile number operator to call you on the 30th of December. Then you will consider making the link after the Supreme Court has given its judgment. Until then, you are under no pressure, to give anybody any data. We can wait for as long as the SC takes. Because the Supreme Court’s word will be final.

Update: interim relief for citizens

Deadline for linking Aadhar with mobile numbers extended till Feb 6, 2018 and March 31 for bank accounts.

Supreme Court today directed banks, service providers to specify last date for linking with Aadhaar in SMSs.

SC also asks Banks, telecom companys not to create panic among people by messaging that their a/c & number would be deactivated for not linking with Aadhaar.

Moreover, the UIDAI on November 02, tweeted saying that there is no need to give finger prints to local sim card retailer for your mobile verification. It added, that from December 01, 2017, you can do it from your home through OTP received on mobile number registered with Aadhaar.
